Active ITC Investigations: Smart Locks and Wireless Earbuds Under Scrutiny

While the confidential resolution removes the immediate threat of an exclusion order, it likely includes licensing terms or design-around commitments that could reshape competitive dynamics. Exporters of robotic vacuums should note that the underlying intellectual property remains enforceable; a settlement does not eliminate the risk that similar claims could be brought against other market participants. Companies entering or expanding in this product space should conduct freedom-to-operate analyses before shipping to the U.S. market.

PatentHold LLC: Serial Plaintiff Activity in E.D. Texas

Patent-assertion entity PatentHold LLC has two pending infringement suits in the Eastern District of Texas—one against Acme Electronics (filed January 2025) and another against Beta Devices (filed November 2024). The dual filings suggest a broader licensing campaign, and additional defendants or ITC complaints are possible. Exporters whose U.S. customers or distributors fall within PatentHold's target technology areas should assess their indemnification obligations and consider whether existing insurance or cross-license agreements provide adequate coverage. The Eastern District of Texas remains a preferred venue for patent plaintiffs due to its historically plaintiff-friendly procedures, making early legal assessment especially important.
